Thirdway Alliance Party leader Ekuru Aukot is calling for the resignation of chairman of the Independent Electoral and Boundaries Commission (IEBC) Chairman Wafula Chebukati failing to clear him and other candidates based on unconstitutional regulations.

In a statement Tuesday, Aukot says Chebukati failed to interpret, protect, uphold the law.

“While we advised the chairman through a letter dated June 5,2022, that the Regulation 18 2C was unconstitutional and ought to be discarded, the chairman was unable to interpret the law correctly and proceeded to deny us clearance and several other candidates based on the unconstitutional regulation. We successfully moved to court and secured a judgement affirming our advice to the chairman,” read part of the statement.

On Tuesday afternoon, Justice Anthony Mrima declared Regulation 18 2C of the Elections Act unconstitutional.

“While it is crystal clear that the unconstitutional regulation was amending article 137(1)(d) through the back door, the IEBC under the leadership of Wafula Chebukati introduced the regulation in 2017 and only decided to use it as a tool for conducting a subjective and predetermined selection process instead of a nomination process” he added.

Aukot also wants the 2017 elections nullified and repeated.

“To add insult to injury, when the Supreme Court ordered that the IEBC organizes for a repeat election, the said Wafula Chebukati illegally and in defiance of the Supreme Court judgement decided to Gazette two individuals only although the election had been declared null and void. We successfully moved the court to enforce the Supreme Court Judgement and the High Court ordered that the name of Dr Aukot be included in the repeat elections ballot paper,” added the Thirdway Alliance Party Leader.

He at the same time called for the nullification of the presidential nomination of the four presidential candidates.

” The unconstitutional presidential nominations of Raila Odinga, William Ruto, George Wajackoya, and Mwaure Waihiga be immediately quashed and the presidential ballot printing be shelved until a proper nomination exercise is carried out in accordance with the underlying law and the constitution and without malice, differential treatment of aspirants and outright bias as demonstrated by Wafula Chebukati,” Aukot stated.

He said Chebukati is unfit to oversee the 2022 general election and the country has no shortage of competent and upright people.

“Kenyans must not forget it is the same Wafula Chebukati was in charge who was in charge of the nullified presidential election of August 2017, which resulted to loss of lives and billions of tax payers’ money.” he added.

Aukot was disqualified after failing to provide signatures and copies of national identity cards of 48,000 registered voters who endorsed his presidential bid.

Chebukati also said that the copies of Aukot’s degree certificates had not been stamped by the universities that he received them from.
