Radio Africa Group has moved to shut down the popular Facebook groups Kilimani Mums Nairobi Uncensored and Kilimani Mums and Dads Uncensored.
The media house is citing an infringement of rights, saying that it owns the ‘Kilimani Mums’ trademark.
Consequently, Radio Africa has had Youtube and Instagram disable accounts bearing the name. It has also written to Kilimani Mums Uncensored administrator asking her to pull down the page.
However, Ms. Nzisa has accused the media group, of unduly attacking the group due to its success and popularity.
“Feeling threatened by the success of Kilimani Mums Uncensored and Kilimani Mums and Dads Uncensored, as well as the positive reception of Kilimani Mums Show, radio Africa Limitd has now written to Instagram, YouTube and Facebook to have all Kilimani mums platforms shut down. Radio Africa claims to own the Kilimani Mums trademark,” wrote Ms. Nzisa, adding that the popular group will file an objection to the copyright claim.
According to Radio Africa, it formed the Kilimani Mums Nairobi Facebook group and copyrighted the name and delegated administrator roles to Andra Bohnstedt.
“The fact that radio Africa owns the Kilimani Mums trademark cannot be disputed. It has come to our attention that there are more than 100 infringers of our trademark including yourselves and we have made complaints to Instagram, Youtube and Facebook regarding all the infringers,” the media house said in an email correspondence.
However, Ms. Nzisa has countered this: “Last time I checked, trade marks are supposed to represent tangible goods, whereas service marks represent services. Common User words such as ‘Kilimani’ and ‘Mums’ are not novel enough for anyone to claim exclusivity to their use. Besides, one cannot trademark words already used by others,” she said.
